These DROPP AI Supplementary Terms (“AI Terms”) form part of the DROPP Terms of Service (the “Agreement”) between you and DROPP SAS (“DROPP”, “we”, “us”, “our”).
These AI Terms apply to your access to and use of any DROPP features, functionalities or services that use artificial intelligence, machine learning or similar technologies (collectively, the “AI Features”), including our AI chat agent used to interact with Fans.
By accessing or using any AI Features, you agree to be bound by these AI Terms. Capitalised terms not defined here have the meaning given to them in the Agreement.
If there is any conflict between these AI Terms and the Agreement, these AI Terms will govern solely for your access to and use of the AI Features.
For the purposes of these AI Terms:
- AI Features: any feature of the DROPP Platform that uses artificial intelligence, machine learning or similar technologies, including our AI chat agent that can converse with Fans on your behalf. AI Features may use technology provided by third-party service providers (“AI Providers”).
- Input: any content, data or information you or your authorised users provide to or through the AI Features (for example: instructions, prompts, example messages, training documents, FAQs, product info, tone of voice, etc.).
- Output: any content or response generated by the AI Features based on the Input (for example: replies sent to Fans, suggested messages, drafts, summaries, etc.).
- Creator / Agency / Fan: have the meanings given in the DROPP Agreement and/or in our Privacy Policy.
The AI Features are part of the DROPP Platform and are governed by:
1. these AI Terms;
2. the DROPP Terms of Service; and
3. our Privacy Policy and, where applicable, Data Processing terms.
All limitations of liability, disclaimers, indemnities and dispute-resolution provisions in the Agreement also apply to your use of the AI Features.
DROPP and/or the AI Providers exclusively own all rights, title and interest in and to the AI Features, including all related software, models, algorithms, user interfaces and documentation.
Except for the limited right to use the AI Features under the Agreement, no other rights are granted to you.
As between you and DROPP:
- you retain all rights in your Input and in the Output generated for you, subject to any third-party rights (for example, if your Input contains third-party content);
- you are solely responsible for how you use the Output (including modifying, publishing, reproducing or commercialising it).
You acknowledge that, due to the nature of AI, similar or identical Output may be generated for DROPP or for other users (“Similar Results”). You have no exclusive rights to any Similar Results.
You are fully responsible for:
• the content of the Input you provide;
• how you configure, train and use the AI Features;
• how the Output is displayed, used, stored or sent to your Fans or other third parties.
You represent and warrant that:
1. you have all necessary rights, licences and permissions to provide Input and to use the Output;
2. your Input and your use of the Output will not:
• violate any law or regulation (including consumer protection, data protection, advertising or platform rules);
• infringe any third-party intellectual property or privacy rights;
• contain or promote illegal, harmful, fraudulent or misleading content;
• contain personal data of minors where this is not lawful or permitted under our policies; or
• include special categories of personal data (e.g. health, sexual orientation, political opinions) unless you have a lawful basis and it is compatible with the Agreement and applicable law.
You must carefully review Output before relying on it or sending it to Fans. You understand that AI can be wrong, outdated or incomplete.
In addition to all prohibited uses in the Agreement, you must not use the AI Features to:
- generate, store or distribute content that is illegal, discriminatory, harassing, defamatory, hateful, violent or otherwise harmful;
- create or distribute sexual content involving minors, non-consensual content, or content intended to exploit or harm individuals;
- impersonate another person, business, creator or public figure without clear permission;
- send spam, unsolicited messages, or messages that violate messaging platform policies (including Meta / Instagram / Facebook / WhatsApp policies / Telegram / TikTok or any other platform integrated on DROPP);
- generate content that provides professional advice (medical, legal, financial, etc.) and present it as if it were human, qualified advice;
- attempt to reverse engineer, extract or reconstruct the underlying models or source code;
- circumvent safety filters or attempt to deliberately cause the AI Features to produce harmful content.
We may suspend or terminate access to the AI Features immediately if we reasonably suspect misuse or violation of these AI Terms or of any applicable law or platform policy.
To provide the AI Features, we may process Input and Output, as well as technical and usage data (logs, timestamps, error reports, configuration etc.).
We use this data to:
• deliver the AI functionality;
• operate, maintain, secure and improve our AI systems;
• comply with legal obligations;
• prevent abuse and ensure compliance with these AI Terms.
We may use third-party AI Providers (for example, infrastructure or model providers). Those providers will process data on our behalf or, in some cases, as independent controllers in accordance with their own terms and privacy notices.
Data processing for the AI Features is further described in our Privacy Policy and, where applicable, in our Data Processing documentation. By using the AI Features, you authorise DROPP to engage such AI Providers and to transfer relevant data to them subject to appropriate safeguards.
If you use AI Features on or in connection with a third-party platform (for example: Meta, Instagram, Facebook, WhatsApp, Telegram, or others), you are responsible for:
If a platform requests that we restrict or disable your AI agent or related features because of a policy violation or risk, you agree that we may do so without liability.
You understand and agree that:
- AI Features generate Output based on patterns in data and do not guarantee accuracy or completeness;
- Output may contain errors, may not reflect the latest information, and may not be appropriate for every context;
- Output is not a substitute for professional advice (legal, medical, financial, tax, etc.) or for your own judgement.
You must not present Output as:
- verified fact;
- advice issued by DROPP;
- professional or personalised advice where laws require a qualified human professional.
You are solely responsible for any decisions or actions taken based on Output.
To maintain the security and quality of the AI Features, DROPP may:
- automatically scan Input and Output for abuse, malware, spam, policy violations or safety issues;
- use human review in limited cases (for example: resolving support issues, investigating abuse, improving safety systems), always under strict confidentiality and minimisation principles.
Where we reasonably believe there is a serious risk of harm, we may take appropriate steps allowed by law (for example, suspending use, cooperating with platforms or competent authorities).
AI Features may be:
• updated, modified or discontinued at any time;
• subject to usage limits, quotas or rate limiting;
• offered as “beta” or experimental features without any committed service levels.
We may introduce or remove individual AI models or providers without prior notice, where technically or legally necessary.
Nothing in these AI Terms obliges DROPP to continue offering any specific AI Feature.
Your use of the AI Features is subject to the same disclaimers, limitations of liability and indemnity obligations set out in the Agreement.
In particular, and without limiting the Agreement:
- DROPP is not liable for any loss, damage or claims arising from your Input, your configuration of the AI agent, or your use of the Output (including messages sent to Fans);
- you agree to indemnify DROPP against any claim made by a third party (for example, a Fan, a platform or a rights holder) resulting from your misuse of the AI Features, your Input or your use of Output.
Any limitation or cap on liability set out in the Agreement also applies to claims arising under these AI Terms.
We may suspend or terminate your access to some or all AI Features:
On termination of your account or of the AI Features, we may retain or delete Input and Output in accordance with our Privacy Policy and legal obligations.
We may update these AI Terms from time to time, for example to reflect:
When we make material changes, we will update the “Effective date” and, where appropriate, notify you via the Platform or by email. Your continued use of the AI Features after any update constitutes acceptance of the updated AI Terms.
